Subotica : “Emergency conditions” end with a mass deportation to Macedonia and a fire in the migrant jungle

On the 8th of February 2012, when the temperatures have been steadily below zero for days, “emergency conditions” were declared in Serbia. Schools and many offices were closed as temperatures dropped below -25°C. The local authorities in Subotica – a Serbian town on the border with Hungary where hundreds of migrants are blocked for months due to increasingly securitised border with Hungary – took a decision to move the migrants from the outdoor make-shift “jungles” made out of old blankets, tarpaulin and scrap material, into an abandoned hotel “Fontana” in Palić, about 10 km from Subotica. On the 22nd of February, it was declared that the “emergency conditions” are over – and things are as they were before. People live outdoors in the jungles – if they have not been among the fifty that have been deported to Macedonia, or if they have not had their tent burnt down.

End of “emergency conditions”, arrests in Palić

An old hotel, turned into shelter for 100-150 peopleThe conditions in the hotel “Fontana” in Palić, while an improvement from staying outdoors in -25°C, were still very difficult. Between 100 and 150 people lived in one big room with poor heating. There was a layer of styrofoam on the floor and a layer of thin mattresses. There was one set of washing facilities and only a 5 litre boiler for hot water. The Red Cross distributed food and provided basic medical checks – but did not provide serious treatment for people, many of whom suffer from chronic conditions from living in the cold and damp with insufficient nutrition for months.
The day after the emergency was declared to be over, the police raided the hotel at around 6.30 in the morning and arrested everyone who was still there. It was clear that everyone was gathered in a hurry and did not have time to collect their personal belongings : a few hours after the raid the blankets laid in piles on the floor, the shoes, clothes and personal possessions were scattered everywhere.
Hotel “Fontana” in Palić, after the police raidPolice did not want to give the exact number of how many people were arrested – but it is estimated to be over 50. This is the biggest arrest in Subotica in a long time. Looking back at the decision to accommodate migrants in Palić during the “emergency conditions”, and then arresting everyone who was still there the day after the official “emergency conditions” were over, it seems like the noble humanitarian inclination to provide people with a warm(er) place during the extreme cold, was just a pretext to gather a great number of migrants in order to arrest them all more easily. Especially because, as it transpired later, everyone arrested was mass deported to Macedonia.

Arrests and a fire in the jungle, deportation to Macedonia

Burnt down jungleOnce the “emergency conditions” were officially over, a number of migrants left Palić. They correctly assumed that the police might raid Palić and returned to the jungles the night before everyone in Palić was arrested. But on the same morning police also raided the jungle. They burnt down one set of tents and arrested everyone that they could catch, said the people who managed to run away from the police that morning. When asked about the fire in the jungle, the police pretended they did not know anything about it.
This is not the first time that the police burnt down the jungles – during a big raid in November 2011 they burnt down the jungle and arrested many people. Everyone arrested was put on buses and deported en mass to Macedonia.
Burnt down tentsLike in November, the purpose of these mass arrests was a deportation to Macedonia, one border back on the path across the more and more securitised borders of the Balkans. After the whole day of trying to get information about what happened with the people who were arrested, the arrestees called in the evening, saying they were all in Macedonia. Many of them wanted to ask asylum – which, according to the Serbian asylum law, they can do at any point of the arrest – but they said the police did not listen to them. They were all put on a bus and driven to Macedonia and let free on the Macedonian side of the border. They have there joined hundreds of others who are trying to cross the increasingly guarded Serbian-Macedonian border, and where conditions of life of undocumented migrants are similarly difficult as in Subotica.

Dysfunctional asylum system, the border is the problem

The police disregarded the law when they refused to acknowledge the expressions of intention to ask asylum. But it should be stressed that the asylum system in Serbia is completely dysfunctional. The reception centers in Banja Koviljača and Bogovadja are full and cannot accommodate all asylum seekers. Furthermore, since the start of Serbia’s asylum system in 2008, there has not been a single person who got granted refugee status. And even if anyone would get a refugee status, there does not exist an “integration” act or strategy for refugees in Serbia. All of this explains why asking asylum and staying in Serbia is, for many migrants, not a bright prospect.
But the border to Fortress Europe is difficult to cross. As the mainstream media and popular discourse abounds with a xenophobic rhetoric, it is often forgotten that the “problem” in Subotica are not “migrants” – but the border itself.

Patra Greece

.In the last several months a few hundred migrants from Afghanistan, Sudan and some others from Algeria, Somalia and Morocco have started to live in this area. It’s precarious ‘housing’ for the people who seek an exit from Greece daily, through the port, to a new life.

Italy violated human rights by returning migrants to Libya, court rules

A Libyan policeman distributes bread to migrants rescued off one of the three boats that sank in a storm off Libya in March 2009. Other migrants may have been exposed to the risk of torture, say human rights lawyers

European court of human rights ruling likely to shape EU immigration policy at time of upheaval in north Africa

Italy violated international human rights laws when it intercepted migrants adrift in the Mediterranean in 2009 and returned them to Libya, the European court of human rights has ruled.
The Strasbourg court ruling on Italy's Berlusconi-era "push back" policies – since suspended – is now likely to play a key role in shaping future EU immigration policy at a time of political and economic upheaval in north Africa.
It is the first time a court has recognised the unlawfulness of the push back operations with regard to international law and human rights," said Andrea Saccucci, one of the Rome lawyers representing the migrants. "We are very satisfied, and hope it will prevent similar actions in the future."
The 11 Somali and 13 Eritrean nationals represented in the complaint were part of a group of 200 migrants, including children and pregnant women, who left Libya in 2009 on board three boats bound for Italy.
Their boats ran into trouble on high seas 35 miles south of Lampedusa. Though they were within Malta's maritime search and rescue region, they were eventually rescued by Italian customs and coastguard vessels.
Italian authorities returned them by ship to Tripoli, where they were handed over to Libyan authorities without efforts to identify them, screen them or offer them asylum procedures.
Lawyers for the migrants argued that such interception violated their rights to seek political asylum and also exposed them to the risk of torture or degrading treatment in detention camps in Libya, or to expulsion back to home countries where they risked further persecution.
Italy had argued it was acting within the EU principles for controlling illegal immigration through partnerships with countries of origin and transit. At the time of the incident, Berlusconi's interior minister, under pressure to stem the massive tide of immigration to Italy, defended the interceptions arguing they were in line with recently signed bilateral agreements with Libya.
The refugees faced poor detention conditions in Libya, which had no domestic asylum procedure, leaving them stuck in "temporary" detention centres that were anything but. Some spent months in Libyan prisons. One of the 22 listed in the complaint who had been turned back to Libya eventually made it back to the Italian mainland and last year was given asylum seeker status. This was proof, his lawyers said, of the contradictory nature of Italy's immigration policy.
"I am very happy inside," the 27-year-old Eritrean national told the Guardian in a telephone interview from Rome. "I am thanking God."
Each of the 22 migrants represented were awarded €15,000 compensation in the judgment.
The UN estimates that more than 1,000 migrants were intercepted by the Italian coastguard and forcibly returned to Libya during the time the policy was in place. "I believe that now the Monti government must take this historical ruling into serious consideration," attorney Anton Giulio Lana told the Guardian. "And keep it in mind as they renegotiate all their immigration agreements with the Libyan National Transitional Council.
"Today's important ruling vindicates what human rights groups argued all along: Italy put these people at grave risk when it pushed them back to Libya," said Judith Sunderland, senior western Europe researcher at Human Rights Watch.

Migrants has been attacked in Greece

Racist attack in Greece: 3 wounded, 2 disappeared

Nabi, a 20-years old Moroccan, is lying on the ground. He looks dead.Twenty minutes earlier we were sitting in the recovered-from-garbage chairs and furniture, smoking cigarettes and chatting in one of the abandoned wagons of the old train station of Corinth (Greece). Nabi lives there with about other 50 migrants from Afghanistan, Iraq, Algeria, Tunisia, Morocco, Yemen. Nasir—a polyglot, art lover Afghan interpreter—asks Nabi, another art lover, to draw something. The young Moroccan sketches the boat of the Hellenic Seaways moored just 200 meters down in the bay. They all are waiting the lucky day in which they will be able to catch the ferry; climbing to it, or hidden in the load of the trucks that the boat carries to Italy. And then… go further North in search for a job, a future, a safe and normal life. Crisis-hit Greece has become a nightmare for them. There is not the slightest possibility for work in a country with rocketing unemployment figures. Greeks don’t want them, neither they want to stay in Greece, but they are stuck here because European Union treaties allow third countries to return them to the state where they first entered the EU. And Greece has been the gate to Europe in the last years for 90 % of migrants.
Now, Nabi is lying on the ground.
Everything happened so quickly: a group of 4 or 5 locals drive their two cars to the old train station claiming that a migrant has stolen some money at the open air market this Saturday morning. They hit the first migrant they find, an old man cooking in an improvised fireplace. The locals try to do the same with other migrants, but the cries raise the alarm and more migrants appear from the old wagons with sticks and stones to expel the assailants. The locals go back to their cars, although one stops and punches another migrant in the face, just before getting in his black Renault Megane. The migrants try to stop the black Renault but the driver makes a U-turn knocking down a migrant, a 35-years old Algerian. He stops the car, its back aiming at us, and hits the gas at full speed in reverse gear. I jump on a small wall, as does the photographer Alessandro Penso and some migrants, to avoid being knocked down by the black car. Others run, but Nabi cannot beat the speed of the vehicle and gets hit. His body flies some meters away in front of our astonished eyes. The insane driver hits the gas and escapes leaving Nabi lying on the ground.
We all run to check his health. He has been badly hit, bleeding his face, but he is alive (later we will know that he got some bones broken). The police arrive and later the ambulance, considerably late since there is no ambulance driver working that day in Corinth (because of the austerity measures cuts) and has to come from a neighboring town
The migrants are in anger and despair. Some cry and claim that two of their Algerian friends –one about 50-years old named Ibrahim and the other a 20 years-old named Hassan- have been kidnapped and put into the first car. They call them on their cell phones, but nobody answers.
“This people come every now and then, with truncheons and sticks. If they find someone alone they beat him till he is almost dying,” denounces a 30-years old Tunisian, too afraid to give his name. “We don’t do anything wrong, we even eat from what we find in between the rubbish not to mess with the local people,” says Abduljalil: “We are only waiting here for the good weather to be able to escape from this country.” “Ten days ago –explains Ahmed, an Algerian- they came and fired me with a plastic-bullet gun. They were driving a white four-wheel drive Toyota”. However, these migrants cannot go to the police station.
“If they come to report something, I have to arrest them as they are living here illegally. I am sorry, but that is the law”, excuses himself a police inspectors of Corinth. Even now when a group of journalists –Italian photographer Alessandro Penso, Greek photographer Giorgos Moutafis, Spanish journalist Antonio Cuesta and myself- have witnessed the attack, the police officers try to downplay the incident.
-“You know… the car owner has some psychiatric problems. We have got him before. He has been at the hospital”, says the police inspector.
-“Maybe… but do his friends also have mental problems?”–we ask him.
-“This morning, the migrants robbed some money in the market…”- justifies the inspector.
-“But even if that happened, this does not give them the right to go and try to kill the migrants” –I complain.
-“Yes, that is your opinion”- says the inspector.
-“No, officer, that is not my opinion. That is the law.”
This happened today, February 18th 2012 in Corinth, Greece at about 3.45 p.m.
UPDATE: At 10.00 pm of Saturday, we had news about any suspect arrest had been made

Bag Mohajer

Bag Mohajer:
